- To successfully place an order, consent to the processing of personal data is required. We process them solely for the purpose of fulfilling the order. More on this can be found in the Privacy Policy tab.
- Prices of all products visible on the waterflex.pl online store website are net prices in PLN (VAT and shipping costs are added when fulfilling the order).
- The store reserves the right to change the prices of goods on offer, introduce new goods to the store's offer, conduct and cancel promotional campaigns on the store's websites, or introduce changes to them.
- The Seller declares that the products sold via the waterflex.pl online store are brand new, covered by the manufacturer's warranty and have all the required certificates.
- The Seller will make every effort to ensure that the products visible in the waterflex.pl online store offer match the Seller's current stock levels. In the event of unavailability of all or part of the goods covered by the order, the Buyer will be informed of this. The Buyer will decide on the method of order fulfillment, i.e. partial fulfillment, extension of the waiting time, or cancellation of the entire order.
- Price offers from the Seller are valid for one week, unless the Seller states otherwise in the offer.
II. TRANSACTION
- Orders in the waterflex.pl online store can be placed via the waterflex.pl store website - by filling out the form on the store's website or by e-mail.
- When placing an order, the Buyer is required to provide correct personal data: name and surname, exact home address, shipping address, e-mail address and contact telephone number.
- The Seller reserves the right to refuse to process an order that raises doubts; the Buyer will be immediately informed of such a situation.
- The stated stock levels may indicate incorrect quantities, although we make every effort to ensure that this does not occur.
- The buyer can obtain information about the order status by e-mail.
- Goods paid for in full leave our warehouse and belong to the Buyer, regardless of the date and method of receipt.
- Goods purchased with a payment deadline leave our warehouse and belong to the buyer on the date the invoice is issued, regardless of the date and method of receipt.
- You can purchase and/or collect goods in the store only by prior arrangement.
III. PAYMENT
- In the waterflex.pl store you can pay in the following ways:
- cash on personal collection - after prior arrangement of the collection date;
- cash on delivery via courier, so-called "cash on delivery" COD;
- by transfer to the Seller's bank account;
- online transfer: Przelewy24 or PayNow;
- by payment card:

* MasterCard Electronic

- In the event of the need to return funds for a transaction made by the customer with a payment card, the seller will make a refund to the bank account assigned to the Ordering Party's payment card.
- The Buyer is obliged to pay the final price stated for each product, which is the total price of the goods and shipping costs.
IV. DELIVERY
- The average shipping time for products is 48 hours from the moment of confirmation of the order and acceptance of the form of payment (confirmation of transfer, crediting the Seller's bank account or cash on delivery) - if the product is in stock in the store.
- Delivery time 24 hours only if the order is placed in the option: cash on delivery, online payment or we are provided with proof of prepayment of the entire amount to the above account by 11 a.m.. Option active on days preceding a working day.
- For an additional fee of PLN 15.00 gross, delivery on Saturday is possible - after consultation with us.
- Shipping time for goods that are not currently in stock - average 1-6 weeks.
- Delivery of goods is carried out via courier services.
- We ship within the country. Please ask the Seller each time about the possibility of shipping abroad - providing the type and quantity of goods and the postal code in the country of receipt.
- Personal collection is possible by prior arrangement, for this purpose please contact us by e-mail or phone.
- Failure to collect the order from the courier will result in the Buyer being charged the shipping costs.
V. WARRANTY
1. The Seller declares that the products sold in the waterflex.pl online store are new and covered by the manufacturer's or importer's warranty.
VI. COMPLAINTS AND RETURNS
- If during the use of the goods the Buyer finds that they have technical defects or are inconsistent with the contract, they may use the warranty services directly from the manufacturer of the product, at the indicated service centers (applies to products covered by the manufacturer's warranty) or conduct the complaint procedure through FLEXIBLE.
- In the event of finding any mechanical damage during delivery or submitting a complaint directly to the seller, the Buyer should contact the Seller and return the goods carefully secured for transport to the address FLEXIBLE, ul. Wrocławska 130, 58-306 Wałbrzych. A damage report and the original proof of purchase should be sent along with the goods. FLEXIBLE does not accept any cash on delivery shipments. Damage caused during delivery and transport will only be considered if the defect is discovered in the presence of a courier employee. In such a case, it is necessary to draw up a damage report in the presence of a courier employee.
- Responses to complaints, reported by e-mail to kontakt@waterflex.pl or by post to the company's address, with confirmation of receipt, are provided within 30 days. In the absence of a response, the complaint is considered justified. In the complaint process, you can expect an exchange of goods - if available, a refund of goods or a reduction in the purchase price.
- FLEXIBLE is liable under the warranty for 2 years from the date of purchase in the event of non-conformity of the goods with the contract in accordance with Art. 10 of the Act on specific conditions of consumer sale of 27 July 2002. The customer loses the rights specified in the aforementioned act if the customer does not notify the store of this fact within two months from the date of finding the goods non-conformity with the contract.
- The Buyer shall file complaints in accordance with the principles specified on the product warranty card. In case of any ambiguities, please contact the Seller. In order for the complaint to be considered, the Buyer's name and surname, order number, proof of purchase number (VAT invoice) must be provided and the subject of the complaint must be described in written and photographic form. It is recommended that the Customer provides the following in the description of the complaint:
- information and circumstances relating to the subject of the complaint, in particular the type and date of occurrence of the defect;
- requesting a method of bringing the Goods into compliance with the Sales Agreement or a declaration of a price reduction or withdrawal from the Sales Agreement;
- contact details of the person submitting the complaint – this will facilitate and speed up the processing of the complaint by the Seller.
The requirements listed are recommendations only and do not affect the effectiveness of complaints submitted without the recommended description of the complaint. Complaints should be sent in writing to the company's address or sent by e-mail to: kontakt@waterflex.pl
The complaint will be considered by the Store within no more than 14 days from the date of its receipt. The Customer will be immediately informed of the results of the complaint.
In the case of a legal person and an organizational unit without legal personality, all actions of this entity may be performed only by a person who is authorized to perform actions related to the use of the Store on behalf of this entity and to exercise all rights and obligations of this entity as a Customer. The Seller is liable to the Customer who is a Consumer if the sold Goods have a physical or legal defect (warranty).
In the event that the delivery of the Goods to the Seller (their warehouse) is necessary for the Seller to respond to the Customer's complaint or to exercise the Customer's rights arising from the warranty, the Customer will be asked by the Seller to deliver the Goods in the case of the Consumer at the Seller's expense. The Customer shall bear the costs of re-delivery of the Goods after considering the complaint in the event of an unjustified use of the warranty (negative consideration of the complaint arising from the warranty by the Seller). In the event of a positive consideration of the warranty, the Seller shall deliver the repaired or new goods to the customer at its own expense.
- The warranty for a Customer purchasing the Goods for purposes directly related to his or her professional or business activity (a Customer who is not a Consumer) is excluded, in accordance with the provisions of the Civil Code.
- The complaints procedure is applied to the Customer-Consumer purchasing the Goods, i.e.:
- individuals making ordinary purchases;
- entrepreneurs who make purchases unrelated to their business activity, i.e. they do not collect a bill or invoice for the entrepreneur's company data;
- individuals running a sole proprietorship, registered in the Central Register and Information on Business Activity (CEIDG), concluding a contract directly related to the business activity conducted, when the content of this contract indicates that it is not of a professional nature for them, resulting in particular from the subject of the business activity conducted by them.

- Warranty and guarantee rights do not apply if the defect was caused by improper installation of the Product or its use contrary to its intended purpose or the manufacturer's instructions.
- Damage incurred during delivery of goods should be reported immediately to the person delivering the parcel and the Seller should be contacted. The condition for considering a complaint regarding a damaged parcel, incurred during transport, is to draw up a "damage protocol" in the presence of an employee of the company delivering the parcel.
- In the event of damage to the shipment, all claims against the courier company must be reported in writing as soon as possible, but no later than 7 days from receipt of the shipment within the meaning of the Act of 15 November 1984 - Transport Law (Journal of Laws of 2012, items 1173 and 1529). For this purpose, the courier should be called to draw up a damage report and send it to us in original. After this period, the customer loses the right to return the damaged goods. We are not responsible for shipments that, at the customer's request, were sent by a courier company other than the one with which we have an agreement
- The consumer has the right to withdraw from the distance purchase agreement within 14 days from the date of receipt of the goods. To do this, they must submit an appropriate statement by e-mail to KONTAKT@waterflex.pl and return the goods no later than within 14 days. The returned goods must be complete and may not bear any signs of use. The original sales document must be attached to the returned goods. The cost of returning the goods is borne by the Buyer. The Buyer is obliged to properly secure the returned goods so as to prevent their damage during transport. If the delivered goods are incomplete or show signs of use, FLEXIBLE reserves the right to refuse to accept the shipment or reduce the amount returned. After receiving the goods, FLEXIBLE will return to the Buyer an amount equal to the purchase price of the returned equipment and will issue a correction invoice to the Buyer and send it to the Buyer's address. After receiving the correction invoice, the Buyer is obliged to sign a copy and send it to the address of FLEXIBLE, trade name WATERFLEX and/or confirm receipt of the correction invoice by e-mail.
- In the event of withdrawal from the contract, the amount due will be transferred to the Buyer's bank account within 14 days from the date of acceptance of the returned goods by the Seller.
- In the event of the need to return funds for a transaction made by the customer with a payment card, the seller will make the refund to the bank account provided by the Ordering Party.
- A Customer who is not a Consumer may, only and exclusively with the consent of the Seller, return/exchange the delivered goods within 3 working days from the receipt of the goods, provided that:
- the goods have not been used and do not show any signs of use;
- the goods are fully valuable, undamaged;
- the goods were not assembled (assembled and then disassembled);
- the goods have original packaging (if any);
- the goods have original documentation (instructions, declarations of conformity, quality certificate, warranty document, etc.);
- the product is not marked in the catalogue with the letter NZ - availability to be agreed, it is not a special, non-catalogue version, in colours other than the standard, it is not an individualised offer.
- In the event of a return/exchange of goods, the Seller reserves the right to deduct up to 30% of the gross value of the order item. The delivery costs of the returned/exchanged goods are borne by the Customer.
- In the event of both withdrawal from the contract and a recognized complaint, the Seller will refund the goods and shipping costs up to the cheapest shipping option available in the given offer. Which is important when the Customer requests urgent delivery, Saturday delivery, a selected courier, or shipping abroad.
- Complaints are not possible for goods to which any modifications have been made, regardless of whether they were made at the Customer’s request by the store or independently, or in the event of mechanical damage.

VIII. FINAL PROVISIONS
- Differences in the appearance of goods sold in the FLEXIBLE online store resulting from individual settings of computer equipment (colour of the product, proportions of the product, etc.) do not constitute grounds for complaint regarding the purchased goods.
- All products and names mentioned are used for identification purposes only and may be registered trademarks of their respective owners.
- Processing of personal data.
In order to properly execute the purchase and sale agreements, Flexible Anna Hochuł, ul. Łączna 11, 58-306 Wałbrzych processes the personal data of the Customers, including: name, surname, address, bank account number, e-mail address, telephone number. Flexible Anna Hochuł processes personal data in accordance with art. 13 sec. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and applies, required by the provisions of Polish law, technical and organizational measures to ensure the protection of the processed personal data and to secure personal data against their disclosure to unauthorized persons, takeover by unauthorized persons, processing in violation of the provisions of the Personal Data Protection Act and change, loss or destruction.
Expressing consent to the processing of personal data by Flexible Anna Hochuł within the meaning of the Personal Data Protection Act is voluntary, however, the lack of consent prevents the completion of the transaction, delivery of the order and any communication with the Customer.
- FLEXIBLE informs that the Buyer's personal data will be processed only for the purpose of effectively confirming the order and delivering the goods to the address indicated by the Buyer. The Buyer has the right to view the personal data stored by FLEXIBLE, change them or completely remove them from the system.
- The court with jurisdiction to hear disputes arising from the sales contract is the court with jurisdiction over the defendant’s registered office or the court with jurisdiction over the place of performance of the contract.
- In matters not regulated by this agreement, the relevant provisions of the Civil Code, the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product shall apply.
- Placing an order in the waterflex.pl online store constitutes full acceptance of these regulations.
- In accordance with Art. 8 sec. 3 item 2 letter b) of the Act on Providing Services by Electronic Means of 18 July 2002, the Customer is obliged not to place any illegal content on the waterflex.pl store website.
